Terms and Conditions for the CARE_PATH for Kids (7/29/2019)

The CARE_PATH for Kids (CPK) is a three-step whole child approach for families of children and youth with special health care needs to engage, plan, and improve care planning and outcomes in partnership with their child’s care teams. Families can partner with their care team(s) in creating plans of care for their child and family.

The CPK model and tools, and CPK website (www.carepathforkids.org) were developed and are maintained by the Child and Adolescent Health Measurement Initiative (CAHMI) at Johns Hopkins Bloomberg School of Public Health, Department of Population, Family and Reproductive Health. The CAHMI originally developed the CPK as a part of a research project (2017-2019) funded by the Lucile Packard Foundation for Children’s Health.

The following Terms and Conditions govern your use of CAHMI’s CARE_PATH for Kids (CPK) website. This website is made available to you by CAHMI. We may change the Terms and Conditions from time to time, and at any time without notice to you, by posting such changes on the website.  BY USING THE WEBSITE, YOU ACCEPT AND AGREE TO THESE TERMS AND CONDITIONS AS APPLIED TO YOUR USE OF THE WEBSITE. If you do not agree to these Terms and Conditions, you may not access or otherwise use the website. By using the website following any modifications to the Terms and Conditions, you agree to be bound by any such modifications to the Terms and Conditions.

You are being given access to and use of the CPK website, tools and resources, upon the express understanding that you agree to these Terms and Conditions. Please read this Agreement carefully. If you do not agree to these terms, any use of the CPK website, tools, or resources by you is unauthorized and you should stop accessing the website immediately. Your continued use of the website will constitute assent to the terms and conditions. By using this website, you expressly agree not to abuse it.   1. CPK Model and Tools Recipient (Recipient): An individual or organization getting access to information or resources on the website www.carepathforkids.org.
  2. CPK Model and Tools Provider (Provider): Child and Adolescent Health Measurement Initiative (CAHMI), The Johns Hopkins Bloomberg School of Public Health, Department of Population, Family & Reproductive Health, 615 North Wolfe Street, Baltimore, MD 21205
  3. CPK Model and Tools (or CPK): Any content available or files available for download on this website.
  4. Ownership: CAHMI is the owner of the CPK Model and Tools, which was developed in the course of research at CAHMI.
  5. Public Benefit: CAHMI wants this CPK Model and Tools utilized for the public benefit to the fullest extent possible.

 

Children's Online Privacy Protection Act

We are in compliance with the requirements of COPPA (Children's Online Privacy Protection Act). We do not collect any information from anyone under 13 years of age. Our website, products and services are all directed to people who are at least 13 years old or older.

Proprietary Rights, including Copyright and Trademarks/Service Marks

The Child and Adolescent Health Measurement Initiative (CAHMI) owns and retains proprietary rights for the CARE_PATH for Kids. All content, formats, information, resources, and functionalities of this website are copyrighted by CAHMI.

Confidentiality

By using CARE_PATH for Kids you expressly agree to the terms set forth in the CARE_PATH for Kids privacy policy, which describes how we may collect, use or disclose your information when you use CARE_PATH for Kids.

Warranties

CAHMI OR JHU PROVIDES THE CARE_PATH FOR KIDS MODEL AND TOOLS ON AN "AS IS" BASIS AND GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO CARE_PATH FOR KIDS. CAHMI AND JHU SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

CAHMI and JHU do not warrant that your use of CARE_PATH for Kids will be uninterrupted, always available, error-free or will meet your requirements, or that any defects in CARE_PATH for Kids will be corrected. CAHMI DISCLAIMS LIABILITY FOR, AND NO WARRANTY IS MADE WITH RESPECT TO, THE CONNECTIVITY AND AVAILABILITY OF CARE_PATH for Kids WEBSITE.

Legal Rights and Limitation of Liability

The CAHM retains all legal rights associated with the operation of this website.

Except to the extent prohibited by law, the Recipient assumes all liability for damages which may arise from its use, storage, disclosure, or disposal of the CPK Model and Tools. CAHMI will not be liable to the Recipient for any loss, claim, or demand made by the Recipient, or made against the Recipient by any other party, due to or arising from the use of the CARE_PATH for Kids Model and Tools by the Recipient, except to the extent permitted by law when caused by the gross negligence or willful misconduct of the Provider. No indemnification for any loss, claim, damage, or liability is intended or provided by either party under this Agreement.

 

IN NO EVENT SHALL CAHMI OR JHU BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE CARE_PATH FOR KIDS.

General Provisions

You agree that Maryland law (regardless of conflicts of law principles) shall govern this Agreement, and that any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the circuit court for Baltimore City, Maryland; provided, however, that if any dispute may be brought only in a federal forum, it shall be brought and conducted solely and exclusively within the United States District Court of Maryland.

Modifications to the website and the services: We reserve the right, for any reason, in our sole discretion, to terminate, change, suspend or discontinue any aspect of the website, including, but not limited to, content, features or hours of availability. We may also impose limits on certain features of the website or restrict your access to part or all of the website without notice or penalty.
